MH Virtual Retreat Programme Terms and Conditions
The following definitions have the same meaning whether they are singular or plural. ‘Commencement Date’ means the date of the Agreement
‘Agreement’ means the agreement constituted by Your offer to purchase a place on the MH Virtual Retreat Programme and the acceptance of that offer which comes into force as soon as 320 sends written confirmation of Your booking to You by email ‘Deposit’ means any payment made by You to reserve Your place ‘320’, ‘We’, ‘Us’ means 320 Media LLC, a US company registered in Delaware with offices at 1049 Havenhurst Drive, West Hollywood, CA 90046 ‘You/Your’ means You, a client reserving a place on the MH Virtual Retreat Programme offered by 320 booking either via a website or at an authorised live event, or a telephone booking made with one of the 320 authorised consultants.
‘Terms and Conditions’ means the terms and conditions set out below and these definitions which together form part of the Agreement between You, and 320.
‘Retreat Fee’ means the total fee payable by You to 320 in respect of the MH Virtual Retreat Programme.
‘Virtual Event’ means the MH Virtual Retreat Programme being a three-day virtual event produced by the MH Virtual Retreat team led by Matthew Hussey live in person at the event. ‘Sites’ means websites operated by 320 or its affiliates
1 Booking Your MH Virtual Retreat Place
Confirmation of Your booking of a place on the Virtual Event will be sent to You by email and on receipt of this email You are assured of Your place on the Virtual Event specified. The Agreement between You and 320 comes into force as soon as 320 sends written confirmation of this booking to You by email.
2 Nature of the Event and General Release
This event is virtual and all activities within the event will be virtual. If You suffer from any physical, mental, cognitive, or developmental condition that impairs, interferes with, or limits a person’s ability to engage in, or participate in, typical daily activities or other similar tasks or actions or any of the virtual activities within the Virtual Event then You should not participate in those activities in any part of the Virtual Event.
There is no requirement or necessity for You to participate in any of the Virtual Retreat activities and in entering into the Agreement You are agreeing that You assume all and any risks associated with Your participation in any of the activities involved in the Virtual Event.
The Virtual Event is for educational purposes only and no warranty is given for the benefits which result from it. You are responsible for any decisions You make or any actions You take as a result of Your attendance and You agree that 320 and Matthew Hussey cannot be held responsible for the results of any such action taken by You.
In agreeing this You agree to release 320, and its employees and contractors from any and all liabilities, injuries, claims, and damages which may arise as a result of Your participation in the Virtual Retreat activities however caused.
3 Financial conditions and payment procedures
Unless specified otherwise the cost of the Virtual Event is always expressed in either Dollars or British Pounds.
4 Payment
You are required to pay a deposit (the ‘Deposit’) to reserve Your place at the Virtual Event. The Deposit is non-refundable under most circumstances. The Deposit will only be refunded to You if You give notice of cancellation by email to 320 within 14 days of the date of this Agreement. Our authorised consultant may agree to accept payment of this balance from You in instalments. Any remaining balance must be paid 14 clear days before Your chosen Virtual Event and is non-refundable.
5 Requests for Changes and Cancellation
Any request by You to change or cancel Your chosen Virtual Event must be submitted by email to retreats@MHretreat.com.
6 Change of Booking Requests
Should it become necessary You may change from Your selected Virtual Event to any other Virtual Event on a different date. You must notify 320 by email to retreats@MHretreat.com. 320 will change the date of Your attendance free of charge providing Your request by email is received by 320 more than 14 clear days before the commencement of the Virtual Event upon which You have been booked. You may only make one such change to Your Virtual Event booking.
7 Cancellation
In the event of You cancelling Your booking or Your non-attendance at the event for any reason there will be no refund of any Retreat Fee payment or part payments made. In the event that 320 feels (in its absolute discretion) it is necessary to delay the performance of this agreement You will not be entitled to cancel this agreement and in such a case 320 is entitled to offer You a Virtual Event on a different date as soon as this can be practicably arranged. You will be offered 2 alternative dates, one of which You must accept. If You fail to accept at least one such date You will be deemed to have cancelled the Agreement and will forfeit any payments You have made.
8 No replacement attendees
Each Virtual Event place is issued to the individual named in the booking confirmation and is exclusively for the use of that person. The benefit of the Agreement cannot be assigned, transferred, or resold by You to any third party nor can You allow any other person who has not paid for their own Virtual Event place to benefit by sharing Your viewing of the event.
9 Other Changes
320 may make changes to the advertised content of the Virtual Event after the date of the Agreement where these changes are not made by 320 in bad faith and insofar as such changes are not (in the opinion of 320) significant and do not affect the overall character of the Virtual Event.
10 Force Majeure and other matters
320 shall not be liable for any failure of or delay in the performance of this agreement for the period that such failure or delay is beyond the reasonable control of 320 and results from an event or events which prevent, hinder, or materially affects the performance of any of its obligations under the Agreement whether or not this could reasonably have been foreseen or provided against. The event or events referred to above may include but are not limited to riot, war, civil commotion, pandemic, or epidemic.

12 Limitation of Liability
You agree that the liability of 320 under this Agreement excludes the following:
a) all liability arising out of fraud or fraudulent misrepresentation or any other loss save that which is excluded by law;
b) all and any liability for loss whether in contract or tort or otherwise which is not a direct consequence of negligence, lack of care, breach of statutory duty or breach of contract by 320;
c) all and any the costs or expenses incurred to enable viewing the Virtual Event
d) any liability for the failure of electronic equipment, computers, televisions, or the failure or interruption of services from any internet providers, or the failure of any software, programme or app that is involved in Your attempts to connect and join the Virtual Event.

320 is responsible for:

The Virtual Event is for educational purposes only and no warranty is given for the benefits which result from it. You are responsible for any decisions You make or any actions You take as a result of Your attendance and You agree that 320 and Matthew Hussey cannot be held responsible for the results of any such decisions or actions taken by You.
15 Photographs and illustrations
320 occasionally provides photographs and illustrations giving a depiction of the Services offered. The purpose of these photographs and illustrations is only to provide You with a visual indication of the general nature of the Virtual Event and they are not to be interpreted as making any representation exceeding this.
16 Recording and Copyright
Any recording of all or part of the Virtual Event by any means is strictly prohibited and infringes the copyright of 320 and Matthew Hussey and will result in Your exclusion from the Virtual Event. You are prohibited from posting or publishing on the internet or elsewhere or making public in any way any recording or reproduction in any form of the Virtual Event or any of the content of the Virtual Event or any of the materials provided to You in any form. Any violation of these terms would allow 320 to seek redress in the form of damages or other action as provided by law.
320 may create and audio, video or photograph record of the Virtual Event and there is a possibility You may be included in any such reproduction as a result of Your attendance. These terms and conditions and Your acceptance and attendance at the Virtual Event confirm Your consent to 320 for the use any of these reproductions of all or part of the Virtual Event for commercial purposes.
17 Code of Conduct
As a participant in the Virtual Event, you must adhere to certain protocols in your interactions with anyone affiliated with the Virtual Event or 320. You must treat others with dignity and respect at all times. You should report inappropriate behavior and comments that are discriminatory, harassing, abusive, offensive, or unwelcome. You should avoid slang or idioms that might not translate across cultures. 320 will not tolerate discrimination, harassment, or any behavior or language that is abusive, offensive, or unwelcome. If you violate this Code of Conduct, you may suffer consequences. You may be given a warning up through being terminated from the Virtual Event and other programming by 320, depending on the severity of the infraction.
18 General Provisions
You agree that:
a) Any failure by 320 to strictly enforce the Agreement at any time shall not constitute and shall not be construed to mean a waiver of any of Your obligations to 320.
b) If any of these terms of use are found unlawful, void, or for any reason unenforceable, then such provision will be considered severable from the remaining terms of use and will not affect the validity and enforceability of the remaining provisions. These terms may be modified only by our posting of changes to these terms of use on our websites.
19 Applicable Law
You agree that the Agreement shall be governed by and shall be construed exclusively in accordance with the laws of England. You agree that all disputes arising out of or in connection with the Agreement shall be subject to the exclusive jurisdiction of the Courts of England.
