Terms of Use

LOVE LIFE CLUB TERMS OF USE

By checking the box next to this Terms of Use, and clicking the “Purchase” button, you, the purchaser of a membership to the “LOVE LIFE CLUB” outlined below (hereinafter “Client”) agree and willingly purchase entry into this community, to be provided with services rendered by 320 Media LLC (hereinafter “Coach”), and you agree you are voluntarily entering into a legally binding Agreement with Coach, including the automatic renewal terms and inclusive of the following terms and conditions mutually agreed upon:

For good and valuable consideration as outlined on the sales page, Client is electing to purchase a monthly or annual subscription to the LOVE LIFE CLUB (hereinafter “Membership”) at the current listed price. In exchange, Coach agrees to provide the services outlined in the Membership Details below, and Membership Addendum attached hereto.

  1. Membership Outline:
    1. Client agrees and understands that he/she is purchasing a monthly or annual subscription to the LOVE LIFE CLUB, a group life coaching subscription that provides its members with resources and community to support them on their journey to find love.
    2. Client acknowledges that he/she has read the Membership Addendum and conducted any additional research necessary to feel he/she understands what is being provided in Membership as well as what is not included. Client agrees to be bound by the terms and conditions outlined herein, as well as the general policies and procedures that can be found in this Agreement and on Coach’s website.
  2. Confidentiality
    1. Following Client’s purchase, he/she will receive access to Membership, and will have gained access to various trade secrets and personal intellectual property of Coach, including but not limited to materials such as verbal advice, mindset guidance, coaching information and proprietary outlines, on-demand training content, masterclasses, and/or other information that may have become available for use through Client’s participation in Membership. Client understands and acknowledges that this information is not to be openly shared with others who have not participated in the Membership. Client agrees not to share, copy, or distribute any documents or other proprietary information obtained through Membership, and agrees that he or she will be in violation of these Terms of Use if he or she uses any of the Content outlined as his/her own material, or repurposes and uses the Content in his/her own coaching business without express written permission of Coach. Client also understands and agrees he/she will not disclose or use any information provided to Client during coaching sessions, discussions, or otherwise.
    2. Should Client breach this provision and disclose confidential or proprietary information belonging to Coach or another participating in the Membership, Client understands additional action may be taken by Coach up to and including legal action.
  3. Testimonials
    1. Client hereby grants Coach an irrevocable, perpetual license to use, share, edit, and otherwise publicize, both inside the Membership and and as marketing material on social media and Coach’s website, any and all “wins” or positive feedback provided by Client to Coach within the Membership community or on any other platform wherein Client references Membership. Coach will obtain Client’s permission prior to publicly posting any review or testimonial, and Client confirms no additional compensation will be owed for the use of the testimonial and Client’s name and likeness. If desired, Coach will post such testimonial anonymously.
  4. Payment and Payment Plans
    1. Client understands Membership may be purchased with a monthly membership or annual membership.
      1. Monthly: If purchasing via the monthly membership option, Client will be billed an initial down payment of the current monthly membership rate, and subsequently charged automatically, in accordance with the Auto-Renewal Terms outlined below in paragraph five (5) the going monthly rate each month thereafter, unless and until properly canceled by Client. Client understands he/she is responsible for the full payment each month, and agrees to pay the sum requested electronically, via Coach’s website or a designated third party payment processor of Coach’s choosing, in full.
      2. Annually: If purchasing via the annual membership option, Client will be responsible for an initial annual payment at the current annual membership rate, and will be subsequently charged each year on the same date in which the Membership was originally purchased, at the agreed upon annual rate in accordance with the Auto-Renew terms outlined in paragraph five (5) below, unless and until properly canceled by Client. Client understands he/she is responsible for the full payment each year in order to remain a member, and agrees to pay the sum requested electronically, via Coach’s website or a designated third party payment processor of Coach’s choosing, in full.
    2. Should Client fail to make timely payments, or if additional payments are not able to be processed, Client understands: (1) Client’s access to Membership may be forfeited if payment is not made within seven (7) days of the date it is due.
    3. If offered, Client may have the opportunity to join Membership for free for fourteen (14) days (the “Trial Period”) during which time Client will need to provide a credit card for payment, but will not be charged until the fifteenth (15th) day, and may cancel anytime during the Trial Period without being charged.
    4. Coach reserves the right to cancel Client’s access to Membership Site should he/she fail to make additional payments in accordance with the Auto-Renewal Terms as outlined below. Should this occur, Client understands she is not entitled to a refund of funds already issued to Coach for access to Membership Site.
  5. Auto-Renewal Agreement
    1. Client understands and agrees that continued access to Membership requires recurring monthly or annual payments, based upon the billing cycle elected by Client upon his/her initial purchase, that will be made by Client on the same day of the month or year as the date Client was first charged. By purchasing access to Membership, and agreeing to these Terms of Use, Client agrees he/she will be automatically charged at the end of each billing cycle, (or at the end of the Trial Period, if applicable) via the same card or manner in which the initial payment was made, and gives Coach express permission to automatically charge his/her chosen method of payment. This process will repeat each billing cycle (monthly or annually) unless and until Client properly cancels his or her membership.
    2. CANCELLATION POLICY: If Client wishes to end his/her Membership, Client must do so no less than 24 hours before the charge is scheduled to withdraw. Any requests for cancellation made less than 24 hours before the automatic renewal is scheduled to charge Client’s card, or made subsequent to the charge, will take effect the following billing cycle, and Client will be charged one remaining month or year.
      1. HOW TO CANCEL: In order to cancel a membership, Client must send an e-mail to support@matthewhussey.com with the subject line MEMBERSHIP CANCELLATION, including the Client’s name, email address, and confirmation of request to terminate his or her membership. Client will be notified upon Coach’s receipt of email, and his or her membership will subsequently be canceled prior to the following billing period, assuming it is more than 24 hours away.
      2. Client may also reach out to customer support at support@matthewhussey.com to request manual cancellation from a Coach team member.
      3. As outlined above, if Client cancels his or her membership less than 24 hours before the automatic renewal is scheduled to charge Client’s card, Client acknowledges and agrees he or she will be charged for the next month, and the cancelation will take effect following this. Should this occur, Client will have access to Membership Site for the year in which Client paid, with membership terminating at the end of the last paid year.
    3. By checking the box on the purchase page confirming agreement to these Terms, Client also confirms he/she is giving unequivocal, clear, affirmative consent to and agreement with these automatic renewal terms, the cancelation policy, and has an understanding of how to cancel before Client’s card is charged for the following billing cycle.
  6. Refund Policy
    1. Following Client’s purchase, if Client is not fully satisfied with Membership, he/she may reach out to Coach via email at support@matthewhussey.com within the first fourteen (14) days after purchase to receive a full refund of the amount paid to join Membership. Following this initial 14-day refund policy, Coach is not able to offer refunds for any reason, and Client’s only recourse is to cancel his/her membership to avoid being charged again.
    2. If offered by Coach on the Membership sales page, Client will be eligible for a fourteen (14) day Trial Period (“Trial Period”) wherein he/she will not be charged until the fifteenth day of membership. If Client joins during a Trial Period, he/she will not be eligible for a Refund following the Trial Period.
  7. Technology
    1. Coach is not responsible for any specific technology Client may need in order to adequately view and utilize Membership. Client’s inability to access Membership due to a technology issue on Client’s end does not qualify Client for a refund, nor does it alleviate Client of his or her responsibility to make payments, unless or until Client’s membership is properly canceled in accordance with the cancelation policy in paragraph five (5).
  8. Medical Disclaimer – Not Medical or Professional Advice
    1. The content and coaching within Membership, as well as all other offerings within Membership are provided for educational and informational purposes only; nothing within Membership is to be considered therapy or counseling, medical treatment or advice, nor is Membership designed as a substitute for medical treatment, mental health therapy, or any other form of counseling or personalized treatment.
    2. Coach encourages Client to consult a therapist and/or physician if he/she suspects he/she may benefit from such services. We will assume that all individuals choosing to purchase Membership will have previously obtained clearance and permission from their applicable personal medical physician or therapist, and have concluded that the coaching and resources within Membership is right for them. Nothing contained within Membership is intended to diagnose, cure, treat, or prevent any medical condition or disease, nor is it to be considered medical advice in any capacity. If you as the Client believe at any time during your membership that you are in need of mental health treatment, or have any intrusive thoughts of self-harm, hopelessness, or any change in your mental health, you agree to immediately terminate your participation in Membership and seek mental health treatment from a qualified professional. Client understands and agrees that Coach is not responsible nor liable for any change in your mental health, whether directly or indirectly related to your participation within Membership. Membership is designed as a self-help coaching tool, not as any kind of mental health treatment. By purchasing access to Membership and continuing to participate, you as the Client confirm your agreement to this provision.
  9. Voluntary Participation
    1. Client understands and agrees that he/she is voluntarily choosing to enroll in Membership and is solely responsible for any outcomes or results. While Coach believes in its services and that Membership is able to help many people, Client acknowledges and agrees that 320 Media, LLC is not responsible nor liable to Client should Client sustain any injuries, experience any changes to his/her mental state, incur harm, or encounter any negative ramifications. Client agrees that he/she is fully responsible for his/her mental and physical health and well-being, including participation in Membership and any results therein.
  10. Disclaimer /No Guarantees
    1. Client understands that all services provided by 320 Media, LLC in connection with the Membership Site being purchased are provided on an “as is” basis, meaning it is without any guarantees, representations, or warranties, including but not limited to warranties relating to quality, non-infringement, fitness for a particular purpose, merchantability, or expectation or course of performance. Client is choosing to purchase access to Membership and work with Coach on a purely voluntary basis and does not hold Coach responsible should Client become dissatisfied with any portion of the Membership.
    2. Client agrees that he/she does not have a cause of action, legal remedy, and is not entitled to a refund should he/she not achieve the results desired following his/her participation in Membership or should he/she experience any undesired results, as long as Coach delivers the Membership services as described in the Addendum below.
    3. Client also understands Coach is not a doctor, nurse, lawyer, financial adviser, licensed therapist, or otherwise, and agrees to hold 320 Media, LLC harmless should any physical, emotional, or financial injury occur as a direct or indirect result of his/her participation within the Membership. The content provided by Coach on his/her website and within the Membership contains information that has worked for Coach and other clients, and may or may not be useful to Client in his/her personal life. Client understands Coach cannot guarantee results from this Membership, including but not limited to finding and maintaining any relationships, and has no expectation of a specific result that he or she holds Coach responsible for.
  11. Intellectual Property
    1. Client agrees and understands that Coach has created numerous original, creative works in connection with the Membership, and agrees that Coach maintains all copyrights and other intellectual property rights in all original or derivative content associated with or included in the Membership, including but not limited to: documents, emails, graphs, products, systems, processes, handouts, worksheets, copy for website or sales pages, and any other original work created by Coach. Client agrees he/she may be granted a limited right to use selected materials in his/her personal life, but understands that the original proprietary rights remain with Coach. Nothing in this Agreement shall constitute a transfer of ownership of any Intellectual Property from Coach to Client, nor grant any license to use the information, other than that which is expressly provided throughout the course of the Membership.
    2. Licensee Rights: Coach’s Limited License to Client: As a “Licensee,” Client understands and agrees that Client will not (a) Copy, edit, distribute, duplicate or steal any information or any Content obtained through Membership without written permission by Coach; (b) Post, distribute, copy, steal or otherwise use any portion of the Membership or its content, or information obtained via other members in the group Membership without written permission by Coach, and understand that any such use may constitute infringement, which may give rise to a cause of action against Client; (c) Claim any content created by Coach as part of the Membership or otherwise given to Client is his/her own, meaning he/she cannot claim any content created by Coach was Client’s work, and use in his/her business as his/her own; (d) Share purchased materials, information, content with others who have not purchased them.
  12. Indemnification
    1. Client, as well as any successors, assigns, next of kin, or other party related to Client agrees at all times to defend, fully indemnify and hold Coach and any affiliates, agents, team members or other party associated with Coach harmless from any causes of action, damages, losses, costs, expenses incurred as a result of Client’s breach of these Terms, Client’s use of Membership, as well as any third-party claims of any kind (including attorney’s fees) arising from his/her actions as a direct or indirect result of Client’s participation in Membership. This expressly includes any and all medical or mental health treatment issues, for which Coach will not be liable for.
  13. Dispute Resolution
    1. Should a dispute arise between Coach and Client, the parties agree to attempt to resolve by good-faith negotiations and discussions. (Client agrees that failure to see results is not a basis for a “dispute” and agrees he or she does not hold Coach responsible for any specific results, or those results which have been achieved by other clients of Coach.) Client agrees he/she will not initiate a “chargeback” with his/her bank as a means of resolving any dispute or refund request from Coach, and expressly agrees and confirms that any charges in connection with Membership are not fraudulent in any manner.
    2. If unable to reach a resolution informally, Client and Coach agree that all disputes will be submitted for Arbitration by the American Arbitration Association, to be completed in California within a reasonable amount of time. Client and Coach agree to participate in the arbitration process in good faith and in a manner that will effectively and efficiently resolve the dispute at hand, including the exchange of any materials, documents, or information. The decision made by the arbitrator is to be final and binding on both parties, and is not to be appealed or otherwise set aside. It is to be enforceable in any court of proper jurisdiction as a judgement of law or decree.
  14. Applicable Law
  15. This Agreement shall be governed by and under control of the laws of California regardless of conflict of law principles, and regardless of location of Client. Client understands this and agrees that the laws of California are to be applicable here.

  16. Amendments
  17. This agreement may be altered, amended, changed, extended, or updated depending on current laws, structure of Membership, or Coach’s business. Client’s continued use of the Membership constitutes an agreement to the most updated version of this Agreement.

MEMBERSHIP SITE OUTLINE ADDENDUM

Client understands, acknowledges, and agrees he/she is purchasing a monthly subscription to Coach’s Membership. While the below is subject to change, at the time of purchase, Membership includes access to the following:

  1. Ongoing, LIVE coaching with coaches from 320 Media LLC, including Matthew Hussey; 
  2. On-demand courses and training;
  3. Guest expert workshops;
  4. Access to a Members-only Community for support and companionship, as long as Client’s participation is not negative or harmful; 
  5. Access to the “Love Life” mobile application (any additional fees may apply depending upon your carrier)
  6. Fourteen (14) day risk-free refund period

Community Access: As part of his/her access to Membership, Client will also be granted access to a closed social media community, where Client and other Membership participants may freely post, comment, and get to know each other. Client understands and agrees that access to this Community platform is a privilege, not a right, and Coach reserves the right to remove Client (or any participant) immediately for any reason, should any comments become inappropriate, harmful, derogatory, or otherwise objectionable by Coach in its sole discretion. Coach will do its best to monitor the Community platform regularly, and will remove any comments or posts that are unacceptable or inappropriate; however, Coach will not be able to police the Community 24/7. Should you as the Client see anything inappropriate within community, please feel free to report such actions or comments to Coach via email at support@matthewhussey.com or via any other means deemed appropriate by Coach. Client understands that Coach will not have any liability or responsibility for anything posted within the Community by other Membership members, and Client does not have a cause of action against Coach nor any action for damages should Client experience anything negative within Community from other members. 

Love Life Club Community Guidelines

Overview

The Love Life Club Community (“Community”) is your space to connect with fellow members, engage with Coach’s team, and participate in monthly missions to enhance your experience in the Love Life Club. This is a safe space where everyone is welcome to share, comment, and connect. To facilitate this and ensure every member feels safe and welcome in our community, we have some guidelines we ask all members to adhere to. Failure to meet these guidelines may result in a temporary mute or the removal of certain privileges within the community. Please be sure to read through everything to ensure you agree. By participating in the Community, you as the Client confirm you expressly and unequivocally agree to these Guidelines:

Guidelines:

  1. Treat others as you would like to be treated. Let’s all strive to leave each person better than we found them.
  2. Be tolerant and understanding toward others’ viewpoints; respectfully disagree when opinions do not align. Even when we disagree, we can do so while being respectful and kind.
  3. Respect the privacy and personal information of other members. We ask that you remain courteous in your messaging and do not share any screenshots or content from this group on social media or other platforms. This is a private group and all images, text, and profile information should be treated as such.
  4. Communicate with courtesy and kindness. Half of what we say is how we say it, so we ask that you please remain cognizant of how we speak to each other in addition to what we say to each other.
  5. Make friends and enjoy yourself. You are always welcome to reply on a thread or share a personal post in the community. Don’t be shy!

By participating within Community, you expressly agree you will not:

  1. Make personal attacks on other community members. Bullying of any kind is not tolerated, nor is making any other member feel small. We are all here to improve ourselves, not tear each other down.
  2. Use defamatory remarks or make false statements against others. Hate speech is not acceptable toward any group. This includes racism, sexism, or other derogatory terms. While you are welcome to your own political views, we ask that you please refrain from sharing them in this group unless they directly relate to a posted topic (such as a question about politics in dating). Religious discussions are also not appropriate for this community.
  3. Post prejudiced comments or profanity. While we do drop the occasional F-bomb here and there, we ask that you remain respectful in your speech and do not use profanity toward other members or excessively in your posts. If another member’s language offends you, please do your best to simply not engage in that comment.
  4. Bully or make inflammatory remarks to other community members. While we understand that you may have a complaint about Membership or another member, you agree to address that with Coach directly, and refrain from leaving these types of comments in the Community. The admin team will remove pricing, program, or member complaints made in the Community.
  5. Solicit other members. We encourage you to share your wins, however, we do ask that you please refrain from soliciting other members in the group. This is a place for us to make new connections and work on ourselves together; it is not a place to look for new customers.
  6. Use this space for customer service questions. This group is not the place to air grievances or discuss billing issues. If you encounter an issue with your membership, please contact our support team. Posts of this nature made in the group will be removed.
  7. Engage in inappropriate communication or privately message other members without their consent: this is a Community where many members are looking for dating advice and love; however, we ask that you do not look for love within the Community, unless both members are expressly consenting to such communication. We reserve the right to remove any member that makes unwanted advances toward other members or to Matthew Hussey - this will not be tolerated, and you as the Client understand that the Community is not meant for this purpose.

Consequences

Coach will take action when we see someone violating these guidelines as much as possible, which may include (a) giving someone a warning, (b) revoking certain privileges or accounts entirely, and (c) removal of members. We request that all community members report behavior that violates our guidelines to our support team. By electing to participate in Community, you as the Client confirm your acceptance of these guidelines. 

Agreement

By logging into the Community and activating your profile, you confirm you agree with the Membership Terms outlined above, and the Community Guidelines outlined herein. You acknowledge that these terms may change at any time and that continued use of our platform is an agreement to these terms.

LOVE LIFE CLUB TERMS OF USE
